This RFQ is not a competitive bidding process nor is it an invitation to bid. By this document, the City intends to reserve to itself, absolute and unfettered discretion to invite, consider and analyze the submissions, select qualified IT consultants and issue a competitive bidding document or negotiate directly with one or more pre-qualified IT consultants as the City considers desirable.

The City, by issuing this RFQ, has no legal duty or obligation to any Respondent until the City requests such services. The City reserves the right to implement a separate pre-qualification process where more specialized services or projects are involved.

The City reserves the right to invite some or all of the successful pre-qualified IT consultants for each individual requirement.

The City, at its sole discretion, may remove a pre-qualified consultant from the pre-qualification list. The reasons for removal of a pre-qualified consultant from the pre-qualification list include, but are not limited to:
 

• Consistent failure of a pre-qualified consultant to submit tenders resulting from this pre-qualification process; and

• Failure of a pre-qualified consultant to meet the overall performance requirements of any contract awarded by the City.

• The City reserves the right to adjust the above noted number of pre-qualified Contractors based on the workload in any calendar year. The City also reserves the right, at its sole discretion, to request a proposal from Contractors who are not pre-qualified under this RFQ for contracts of a unique, specialized or extraordinary nature.
