This RFQ is not a competitive bidding process nor is it an invitation to bid. By this document, the City intends to reserve to itself, absolute and unfettered discretion to invite, consider and analyze the submissions, select qualified construction managers and issue a competitive bidding document or negotiate directly with one or more pre-qualified construction managers as the City considers desirable.

The City, by issuing this RFQ, has no legal duty or obligation to any Respondent until the City requests such services. The City reserves the right to implement a separate pre-qualification process where more specialized services or projects are involved. The City reserves the right to re-open this Pre-Qualification process at any time if additional pre-qualified managers are required.

The City reserves the right to invite some or all of the successful pre-qualified construction managers for the construction proposal requirement.
